What is the NIE application for international investors?

The procedure for obtaining the NIE granted by the General Directorate of the Police, issues identification effects to natural persons who, due to their economic, professional or social interests, are related to Spain. The NIE is a personal, unique and exclusive number of sequential nature.

What are the main benefits?

Income Tax Deduction

The deduction in the Personal Income Tax (IRPF) for investment in new or recently created companies (not necessarily Spanish startups) is enhanced, increasing from 30% to 50%. The maximum investment that qualifies for the deduction is raised from 60,000 to 100,000 euros

Deadlines to invest

Investment can be made in new or recently created companies during the first 5 years of the company's life (previously 3 years) or 7 years for Spanish emerging companies

Exemption on shares or participations

Increase in the exemption from 12,000 to 50,000 euros annually for the issuance of shares or stakes to employees of emerging companies, along with special rules for valuation and allocation of non-exempt income.

What documentation do you need?

  • Official form (EX15) in duplicate.
  • Form (790 Code 12) with proof of payment at the corresponding bank.
  • Original and copy of a valid and current passport or identity document from your country of origin (the latter only for citizens of EU countries).
  • If the application is made through a representative, it must be legally compliant.
  • Any foreign public document must be previously legalized by the consular office of Spain with jurisdiction in the country where the document was issued, or, if applicable, by the Ministry of Foreign Affairs and Cooperation, unless the document has been apostilled by the competent authority of the issuing country under the Hague Convention of October 5, 1961, and unless the document is exempt from legalization under an International Agreement.
  • When submitting documents from other countries, they must be translated into Spanish or the co-official language of the territory where the application is submitted. This translation must be carried out by a sworn translator.
  • Non-EU foreigners entering Spanish territory from a State with which Spain has signed an agreement to eliminate border controls must declare their entry (Entry Declaration) at the time of entry or personally within three business days at any National Police station or Foreigners Office.

What are the steps you should follow?

Step 1. Access to the National Police website

Access the National Police website and download the following documents:

  • Form "Application for Foreigner Identification Number (NIE) and Certificates (Form EX15)"
  • Form “Model 790 Code 012”. For payment the user must select "Assignment of Foreigner Identification Number (NIE)" with a fee of €9.84.
Step 2. Completion of the form and payment of the fees

Complete and sign each field specified in the aforementioned form and pay the fee at Banks, Savings Banks, and Credit Cooperatives.

Step 3. Submission of the documentation

There are different options depending on the applicant's situation, although all require the procedure to be carried out on site.

  • Submit the application on site in Spain, at Foreigner's Offices or Police Stations.
  • Submit the application through a representative in Spain.
  • If the applicant is not in Spanish territory at the application time, request the assignment of NIE from the General Immigration and Borders Division through the Spanish Consular Offices abroad.
Step 4. Resolution

The procedure must be resolved within a maximum period of five days from the date of entry of the application into the register of the competent authority for processing.

According to art. 210.9 of RD 557/2011 of April 20, which approves the Regulation of Organic Law 4/2000 on the rights and freedoms of foreigners in Spain and their social integration, the loss, destruction, or rendering unusable of the Foreigner Identity Card will lead to the issuance of a new card at the request of the interested party. 
This will not be considered a renewal and will be valid for the remaining period until the expiration of the replaced card. If the request for the new card is made within the renewal period of the authorization, the procedures will be processed jointly and consistently.

The card must always be collected at the same Documentation Unit where it was issued. 

Appointments are personal; you must schedule an appointment for each family member.

Art. 210.7 of RD 557/2011 of April 20, which approves the Regulation of Organic Law 4/2000 on the rights and freedoms of foreigners in Spain and their social integration, establishes that the Foreigner Identity Card will have the same validity period as the authorization or recognition of the right justifying its issuance. It loses validity when the mentioned authorization expires for any reasons established in its applicable regulations or, if applicable, the loss of the right to stay in Spanish territory.

You must request the refund at the Documentation Unit where you applied for your card.

The collection will always be carried out by the holder of the TIE, unless it is a citizen under 6 years old. In this case, it can be collected by the person holding parental authority (FATHER or MOTHER) or legal guardianship, or a person authorized by them, duly accredited.

Whenever the card is lost or stolen, even if it is expired, you must file the corresponding report, which you must provide when applying for the new card.
